Jack Conway nails Dr. Suess [Opinion: The Arena]

Kentucky Attorney General Jack Conway and his Office of Medicaid Fraud and Abuse Control today announced the indictment of a psychiatrist who practices in Hanson, Ky. and owns the Western Kentucky Center for Psychiatric Medicine. A Hopkins County grand jury indicted Osteopath Lawrence Edward Suess on 14 counts of Medicaid fraud following an investigation of his billing practices. The charges are Class D felonies punishable up to a maximum of five years in prison on each count if convicted.

larry suess2.jpgThe indictment alleges that Dr. Suess intentionally or wantonly submitted fraudulent and false claims to Medicaid by claiming he provided interactive individual therapy sessions that paid at higher rate than the insight oriented sessions he actually performed. The indictment also alleges that he fraudulently billed for family therapy sessions. The charges allege that from January 2005 through September 2007, Dr. Suess fraudulently billed Medicaid for individual and family therapy sessions involving 12 patients.

A warrant was issued for Dr. Suess' arrest. His arraignment is set for January 10, 2012, at 1:30 p.m. (CST) in Hopkins County Circuit Court.

Investigators from Attorney General Conway's Office of Medicaid Fraud and Abuse Control investigated this case and prosecutors from the office are handling the prosecution of the case in Hopkins County Circuit Court.

Since Attorney General Conway took office in January 2008, his Office of Medicaid Fraud and Abuse Control has recovered or been awarded more than $210 million for the state and federal Medicaid programs. These cases range from lawsuits and settlements against pharmaceutical companies to cases against individual providers.

General Conway wants us all to remember:  “A charge is merely an accusation. A defendant is presumed innocent until and unless proven guilty.”
